What is the Smoking Cessation Trust?

In late 2011, the judgment in a 14 year old class action lawsuit entitled Scott v. American Tobacco Company became final. That judgment ordered certain tobacco companies to fund a statewide 10-year smoking cessation program to benefit more than 200,000 Louisiana smokers who are members of the plaintiff class (the "Scott Class"). The recipient of the award was not a single nor group of individuals, but a court-established and court-supervised smoking cessation program to benefit Louisiana residents who began their smoking habit before September 1, 1988. The tobacco companies have since deposited the funds with the Court and the Smoking Cessation Trust ("SCT") has been established, all pursuant to the judgment.

Can I be paid by the Smoking Cessation Trust resulting from this court judgment?

No, benefits of this judgment are in the form of FREE smoking cessation services.

What medical and/or pharmacy services are covered by the Smoking Cessation Trust?

If you are an approved MEMBER, SCT will arrange for you to receive, at no cost to you, any of the following cessation services: cessation medications, individual / group cessation counseling, telephone quit-line support, and/or Intensive cessation support services, when such service are listed as Available Services in the SCT program.

What do I have to do to become an Approved Member of the Scott Class?

You must complete an application, currently live in Louisiana, and attest that you smoked a cigarette prior to September 1, 1988. You can access our on-line application at www.smokingcessationtrust.org or by calling SCT Management Services, L3C at (504) 529-5665 or toll free at (855) 259-6346.

Can I qualify if I use smokeless tobacco products (i.e., chewing tobacco, dip, snuff, etc), but do not smoke cigarettes?

No. The funding only those who want to stop smoking and who smoked a cigarette prior to September 1, 1988 qualify.

How much will it cost me to join the Smoking Cessation Trust?

Participation in the Smoking Cessation Trust program is FREE to everyone who completes an application and is approved as a qualified Member.

Why is the Program FREE?

Some of the largest tobacco companies in the world were ordered by the court to provide funding for this program.

Do I have to live in Louisiana to take part in the Smoking Cessation Trust program?

Yes, in order to be approved as a Member you must reside in Louisiana.

How long do I have to live in Louisiana before I qualify?

There is no minimum length of residency required, but you must reside in Louisiana on the day you apply. If you are a relatively new resident, you may be required to present some form of proof of residency to qualify. We will contact you should we need your help with this.

Why is membership in the Scott Class restricted to Louisiana residents who smoked a cigarette prior to September 1, 1988?

The Scott, et al. vs. American Tobacco Company, et al. class action lawsuit was dependent on Louisiana’s Civil Code, which changed on September 1, 1988 when the Louisiana Product Liability Act (La. R.S.9:2800.51) became law. The Fourth Circuit Court of Appeals stated, “The LPLA is the exclusive remedy available to post-1988 smokers and pre-1988 smokers, whose injury accrued after that date. Since the jury rejected the plaintiff's claims under LPLA, this group is not entitled to any award, even smoking cessation treatment. The only remaining group of plaintiffs that is eligible to receive cessation assistance is the pre-1988 smokers, whose claim accrued before 1988.”

Is there an age minimum or requirement for me to belong to the Trust?

There is no age requirement, but you must have smoked a cigarette prior to September 1, 1988 to qualify. (Probably late 30’s or older)

What is the process for approving/disapproving my Application to become an Approved Scott Class Member?

Once your application has been reviewed for completeness by an SCT Management Services team member, your application information will be reviewed by the Judge Presiding over SCT and if approved, your profile will be set up in our system to receive program benefits.

What happens once I am approved?

Once approved, your records in the SCT Management Services computer database will be activated. You will then, within about a week, receive a welcome packet with materials on how to use the program. You should also expect a phone call from our smoking quit-line vendor, Nurtur, who will welcome you to the program and, if you would like, coach you by telephone to set a quit-date and share tricks to improve your chances of quitting.

What do I do with the Smoking Cessation Trust program ID Card?

Once you receive your ID Card, call the phone number on the for activation instruction. Keep the card handy in case you visit a physician, join an individual / group cessation program, or need to obtain products to assist you in your quit attempt that are available at local pharmacies. Telephone numbers and identification numbers on that card will be used by providers, counselors/counseling programs, and/or pharmacies to obtain payment for any Available Services they provide to you.

Does the program require that I go to see a doctor or take special medicines?

No. Sitting down with your doctor to decide the best cessation treatment based on your medical history is still the best way to start. We do not require specific treatment choices be followed; you decide. You can decide between the following basic options: Phone support/coaching, Physician assistance, Group Cessation Counseling, &/or Medications.

Can I get nicotine gum, nicotine patches, or other smoking medicines without having to pay anything?

Yes, if you present your program ID Card at the pharmacy counter that participates with US Scripts, our Pharmacy program vendor. Note, however, that all medicines covered by the program require a prescription from your physician.

Are E-Cigarettes covered?

No, the court order that established the Smoking Cessation Trust ordered the Trust to establish "an evidence-based" cessation program. Very few studies have evaluated E-cigarettes, so they are currently excluded from the services covered by the Smoking Cessation Trust.

Is Hypnosis covered by the Smoking Cessation Trust?

No, the court order that established the Smoking Cessation Trust ordered the Trust to establish "an evidence-based" cessation program. Very few studies have evaluated hypnosis as a treatment for tobacco addiction, so it is currently excluded from the services covered by the Smoking Cessation Trust.

Is Acupuncture covered by the Smoking Cessation Trust?

No, the court order that established the Smoking Cessation Trust ordered the Trust to establish "an evidence-based" cessation program. Very few studies have evaluated acupuncture as a treatment for tobacco addiction, so it is currently excluded from the services covered by the Smoking Cessation Trust.

How many times can I try to quit and have the Smoking Cessation Trust pay for the treatment?

Twice each benefit year for any Member of the Program. Each Member is eligible for a full course of treatment (120 days long) two times each benefit year, for the remainder of the program (until mid-2022).

Will my employer or insurer be notified of my participation?

No.
